Bradley W. Small, a shareholder in the law firm of Mathis, Marifian & Richter, Ltd. (MM&R) recently spoke at the Ag Lenders’ Conference in Springfield, IL regarding Chapter 12 Bankruptcy Reorganization. The conference, held on February 3, was sponsored by the Community Bankers Association of Illinois.

Small, an attorney at MM&R, was pleased with the conference turnout.

“It was nice to see so many banks and bank regulators from Central and Southern Illinois who want to continue educating themselves on Chapter 12 rules and regulations,” said Small.

The goal of the Ag Lenders’ Conference was to help agricultural lenders develop the skills and tools to better understand the issues affecting their farm and agribusiness customers.

Small spoke about steps that should be taken in order to protect a bank’s interest when a customer files a Chapter 12 reorganization case. His topics of discussion included protection of a bank’s collateral, claim treatment in the Chapter 12 Plan, timeframes and deadlines, and the role of the trustee.

Small focuses his practice on banking law, bankruptcy, real estate law, estate planning, and commercial litigation, and has more than 37 years’ experience in handling these matters for financial institutions and commercial enterprises. In addition, he has represented clients in cases involving breach of contracts, bank collections, foreclosures, real estate disputes, probate litigation, bankruptcy, estate and corporate matters.

Small is an AV preeminent rated attorney, which is the highest certification awarded by Martindale-Hubbell and only given to a small percentage of all lawyers nationally. He has been recognized as a Leading Lawyer in the areas of banking and financial institution law, commercial litigation, creditor’s right/commercial collections, probate and real estate law, a distinction given to only the top 5% of lawyers.

Small is currently a member of the Illinois State Bar Association Banking, Bankruptcy & Commercial Litigation Section. He practices law in both Belleville and Nashville, and throughout Southern Illinois and Missouri.
